Public-source verification2026-10-31

This draft outlines the main regulatory entry points for retail, wholesale, and manufacturing of human medicines in Colombia: premises/pharmaceutical-service authorisation by the local health authority, product sanitary registration and GMP certification by INVIMA, and separate registration for controlled drugs. Farmacia-Droguería, Droguería, medicine warehouses, specialised medicine agencies, and pharmaceutical laboratories are not subject to the same licence; nor does company or premises authorisation replace product registration, VUCE cross-border procedures, individual professional registration, or controlled-drug registration. Prepared by Rengangyongsheng (Hong Kong) Limited and explained by Business Manager Tang Shangyong (Drew Tang), this material is for independent third-party project coordination and information collation only; it does not guarantee approval, fixed timelines, or expedited approval.

This article covers pharmaceutical business licensing matters based on local public sources. Separate requirements may apply to retail, wholesale, manufacturing, product registration, imports and exports, and local rules; cross-check against the competent authorities’ current requirements before proceeding with a project.

Quick comparison of 3 types of business activity

Distinguish licensing pathways according to the activities actually undertaken. For personnel, premises, product and cross-border requirements, consult the corresponding sections and official sources below.

Business activityScope of applicationCompetent authorityKey personnel
Retail Pharmacy-Droguería or Droguería Business AuthorisationRetail establishments include Farmacia-Droguería and Droguería. The former may receive, store, dispense, and compound prescriptions within the legally permitted scope; the latter handles receipt, storage, and dispensing. If controlled drugs are involved, the relevant controlled-drug registration must also be obtained. The local health authority for the proposed location is an important receiving authority for premises authorisation, inspections, and routine supervision; INVIMA is responsible for relevant product sanitary registrations and oversight within its remit.A Farmacia-Droguería is generally headed by a chemist-pharmacist; for non-sterile topical compounding only, a pharmacy management technician may be responsible. The legally recognised categories of responsible person for a Droguería are broader and may include a chemist-pharmacist, pharmacy management technician, Droguería manager, licensed pharmacist, or medicine vendor. The actual appointee and qualifications must be verified by the local authority in light of the processes to be conducted.
Wholesale Pharmaceutical Establishment Business AuthorisationWholesale establishments include pharmaceutical laboratories, specialised medicine agencies (Agencias de Especialidades Farmacéuticas), and medicine warehouses (Depósitos de Drogas). Agencies and warehouses that do not repackage handle receipt and storage; higher professional and GMP requirements apply where repackaging is involved.Confirm the local point of contact for premises and pharmaceutical-service authorisation and inspections with the health authority of the proposed department, district, or municipality; INVIMA handles product sanitary registration, GMP, and cross-border product procedures within its remit.Specialised agencies and medicine warehouses that do not repackage must be headed by a chemist-pharmacist or pharmacy management technician; a medicine warehouse that repackages may be headed only by a chemist-pharmacist. Individual ReTHUS or other applicable professional qualification checks must be completed separately from premises authorisation.
Pharmaceutical Manufacturing and GMP Compliance Certification PathwayA pharmaceutical laboratory is a wholesale pharmaceutical establishment, but its operation remains subject to specific pharmaceutical manufacturing regulations. The actual scope of activities, such as production, quality control, and packaging, should be verified individually against INVIMA’s GMP certification and the corresponding product sanitary registration.INVIMA receives applications for inspections related to Good Manufacturing Practices (BPM) certification and is responsible for product sanitary registration, oversight, and corresponding measures; the local health authority may still perform local authorisation or inspection functions for the actual premises.GMP covers quality assurance, quality control, validation, sanitation, complaints, production, recalls, audits, personnel, equipment, premises, and documentation. Where an establishment carries out preparation, transformation, compounding, mixing, adjustment of dosage concentration, refilling, or repackaging, its technical management may be carried out only by a chemist-pharmacist.

01

Scope and entities / foreign investment

This record discusses only regulatory entry points for retail, wholesale, and manufacturing of human medicines in Colombia. It is not a financial licensing guide and does not treat the specific regimes for medical devices, food, cosmetics, veterinary medicines, homeopathic products, or herbal medicines as rules for ordinary chemically synthesised medicines. Pharmaceutical establishments are classified as wholesale or retail according to their business processes; pharmaceutical laboratories remain subject to specific regulations.

The nationwide sources reviewed do not provide a foreign equity percentage, minimum capital, company form, or premises-area requirement that can safely be summarised as applying to all pharmaceutical retail, wholesale, and manufacturing businesses. Investors should separately confirm requirements with the commercial registry, foreign investment authorities, and the authorities for the proposed location. Until an official response is obtained for the specific project, this draft makes no claim that any ownership restriction does or does not exist.

— Retail: Farmacia-Droguería and Droguería; local premises authorisation and product/specific permissions are handled separately.

— Wholesale: pharmaceutical laboratories, specialised medicine agencies, and medicine warehouses; processes and responsible persons differ according to whether repackaging is performed.

— Manufacturing: assess INVIMA GMP, product sanitary registration, and applicable local premises requirements together.

02

Authorities and allocation of legal responsibilities

The Ministry of Health and Social Protection is the competent authority for the health sector. INVIMA is the national medicines regulatory agency and handles product sanitary registration for medicines, Good Manufacturing Practices certification, cross-border sanitary procedures, and oversight within its remit. Local health authorities, together with INVIMA and the National Health Superintendence, conduct inspections, oversight, and corrective actions according to their respective powers.

This means that premises authorisation from the health authority of the proposed department, district, or municipality and product/manufacturing administrative procedures with INVIMA are parallel but distinct compliance workstreams. Separate requirements also apply to professionals registered with ReTHUS, controlled-drug registration with the FNE, and registration with the local Fondo Rotatorio.

— Local health authority: local authorisation, inspections, or sanitary assessment for business premises and pharmaceutical services.

— INVIMA: product sanitary registration, GMP, and VUCE-related sanitary pre-clearance.

— FNE/local controlled-drug authority: controlled-drug activity registration and monthly reports.

03

Pharmacies and retail

Retail pharmaceutical establishments include Farmacia-Droguería and Droguería. The former is regulated for processes involving receipt, storage, dispensing, and prescription compounding; the latter is regulated for receipt, storage, and dispensing. Before commencing retail operations, the proposed establishment should confirm its business authorisation, registration, inspection, and the boundaries of its actual processes with the relevant local health authority.

The Bogotá Health Secretariat states that retail pharmacies in its jurisdiction should first register, conduct a self-inspection, and apply for an inspection, and then obtain a sanitary assessment based on the on-site circumstances. This illustrates local implementation and is not a uniform procedure for every region nationwide. The Secretariat also states that current regulations no longer impose minimum distance requirements for opening or relocating, so the 75-metre claim found in older materials should not be relied on.

— Confirm whether the proposed business is a Droguería or Farmacia-Droguería, and specify whether it will compound prescriptions, maintain a cold chain, or handle controlled drugs.

— Obtain the current application forms, inspection checklist, land-use/address requirements, and document requirements from the health authority for the proposed location.

— Before sale, verify the INVIMA product sanitary registration, sales conditions, and storage requirements for each product.

04

Wholesale and Warehousing

Pharmaceutical laboratories, specialised medicine agencies, and medicine warehouses are wholesale establishments. Agencies and medicine warehouses that do not repackage handle receipt and storage; medicine warehouses that repackage also handle repackaging and are subject to different rules for the technical manager. If distribution, transport, or pharmaceutical processes on behalf of third parties are actually carried out, they are also subject to oversight under the corresponding service-process requirements.

The official service page of the Caldas Department Health Secretariat includes medicine warehouses and specialised medicine agencies among the establishment categories eligible to apply for business authorisation. This directly illustrates local authority involvement in premises authorisation; however, the documents and timelines on that page are specific to Caldas and cannot replace the current checklist of the authority for the proposed location.

— First confirm whether the premises are an agency, warehouse, or laboratory, and whether repackaging will be performed.

— Maintain written records for receipt, segregation by quality status, stock rotation, returns, and transport handovers.

— For wholesale of controlled drugs, separately complete the applicable registration with FNE and submit monthly reports.

05

Manufacturing and GMP

Pharmaceutical manufacturing should be centred on INVIMA certification of compliance with BPM Good Manufacturing Practices. INVIMA states that BPM applies to domestic and foreign pharmaceutical industries whose medicines are sold in Colombia; the system covers quality assurance and control, validation, sanitation, complaints, production, recalls, audits, personnel, equipment, premises, and documentation. Product registration, GMP status, and the actual manufacturing site should remain consistent.

If a pharmaceutical establishment carries out preparation, transformation, compounding, mixing, adjustment of dosage concentration, refilling, or repackaging, it must obtain an INVIMA GMP compliance certificate, and technical management must be carried out by a chemist-pharmacist. Technical standards differ for sterile products, biological products, medical gases, homeopathic products, and herbal medicines; they must be applied separately according to product category and cannot be covered by this general pathway.

— Determine the applicable BPM manual, inspection tools, and application documents according to the products and scope of activities.

— Prepare evidence of the quality system, premises and equipment, personnel, validation, complaints, recalls, and document control.

— Before changing production, packaging, labelling, or the manufacturing site, determine whether both a GMP change and a product-registration amendment are triggered.

06

Professional Personnel and Individual Registration

Technical managers for retail and wholesale establishments must meet the legally recognised category applicable to the establishment type and actual processes. A Farmacia-Droguería is generally headed by a chemist-pharmacist; a Droguería may use other legally listed categories of responsible person; an agency or warehouse that does not repackage may be headed by a chemist-pharmacist or pharmacy management technician; a warehouse that repackages may be headed only by a chemist-pharmacist.

ReTHUS is a personal information register for health professionals who have met statutory requirements and are authorised to practise the relevant health profession or professional activity; registered information must be kept up to date. It is separate from company formation, premises business authorisation, GMP certification, and product sanitary registration. The project should verify each layer and should not treat one as a substitute for another.

— Obtain evidence of the proposed technical manager’s qualifications, registration, and employment/service relationship applicable to the target establishment and processes.

— If controlled drugs are involved, prepare the certificates and contracts required under controlled-drug rules for a chemist-pharmacist or pharmacy management technician.

— Before a person leaves, changes roles, or updates their qualifications, confirm with the local authority whether this triggers an update to premises information or an inspection.

07

Premises, Facilities and Storage

Pharmaceutical establishments should have physical facilities, necessary equipment, tools, materials, and suitably qualified personnel commensurate with their complexity, activity processes, and staffing levels. The premises should be independent, dedicated, have restricted access and circulation, be accessible, and have lighting, ventilation, floors, walls, ceilings, sanitation, and electrical conditions conducive to maintaining medicine quality.

There should be written procedures for medicine receipt and storage covering, at a minimum, site selection, facility design, preservation conditions/resources, and methods to ensure appropriate stock rotation. The Bogotá inspection guide gives examples including shelving, temperature and humidity records, and refrigeration where necessary; actual equipment and validation depth should be determined by product storage labels, business processes, and the local inspection checklist.

— Plan separate areas for receipt, awaiting inspection/quarantine, accepted stock, returns, recalls, and non-conforming products.

— Establish mechanisms for temperature, humidity, cold-chain, cleaning, pest control and record-review requirements according to product storage conditions.

— Establish linked procedures for transport, packaging and delivery to prevent damage and mix-ups and ensure traceability.

08

Documentation and application process

Retail, warehousing, agency and other non-manufacturing premises should first confirm the business authorisation pathway with the health authority for the proposed location. The Caldas local page indicates that applications may require identification of the legal representative or owner, a written application explaining the opening or relocation, a signed business authorisation form, a premises floor plan/sketch, proof of land-use compatibility, and an employment contract where the technical director is not the owner. This is a useful example of how to organise supporting documents, not an exhaustive nationwide list.

For manufacturing or specific GMP activities, apply separately to INVIMA for certification under the applicable BPM pathway. At the product level, sanitary registration and IUM applications for new products, VUCE pre-clearance for imports, and controlled-drug registration each follow separate procedures and are not automatically obtained as attachments to local premises authorisation.

— Step 1: Confirm the type of business, the jurisdiction of the proposed location, the product scope, whether compounding/repackaging will take place, and whether controlled products are involved.

— Step 2: Obtain the current checklist from the local health authority and prepare documents relating to the legal entity, address/land use, floor plan, responsible persons and processes.

— Step 3: Schedule INVIMA GMP, product registration, IUM/VUCE or controlled-drug applications in parallel, and ensure consistency in the company name, address and responsible-person details.

09

Fees, processing times and validity

This review did not identify a uniform nationwide government fee, processing time or validity period for premises authorisation that applies to all ordinary pharmaceutical establishments. Confirm current fees and procedures separately with the health authority for the proposed location and INVIMA; do not promise a fixed approval period, fast-track route or uniform annual fee.

The Caldas page lists a 30-working-day response time, but this applies only to the service information published for that department and cannot be treated as a nationwide commitment for Colombia. Product sanitary registration for medicines is distinct from premises authorisation: the consolidated text of Decree No. 677 shows that sanitary registration for medicines is valid indefinitely, but INVIMA may still take measures in response to technical non-compliance or pharmacovigilance risks.

— Check local premises fees, INVIMA GMP/registration fees, VUCE project fees and controlled-drug fees separately.

— Allow project contingency for requests for additional information, inspections, translation and quality documentation, but do not treat internal plans as official timelines.

— Check the validity or subsequent requirements stated in the relevant product registration, GMP certificate and local authorisation documents.

10

Operations, renewal and ongoing compliance

Ongoing operations require maintaining the personnel, premises, equipment, storage conditions and written procedures required for the authorised processes, and remaining subject to inspection and oversight by the local health authority, INVIMA and other competent authorities. Manufacturing activities must also continue to meet BPM requirements; INVIMA’s certification page publishes materials and guidance for notifying changes to certification conditions, indicating that changes to those conditions should not be treated as internal records only.

The handling of controlled substances or controlled drugs also entails registration and monthly reporting obligations. Wholesale establishments submit applicable distribution information to FNE, while retail establishments and healthcare service providers submit applicable distribution or dispensing information to the relevant local Fondo Rotatorio. The monthly reporting deadline specified in the rules is within the first 10 calendar days of each month.

— Periodically review records for temperature and humidity, stock rotation, receipt, returns, complaints, recalls, training and document control.

— Monitor the GMP status of manufacturers, packagers and labellers, and changes to certification conditions.

— If handling controlled products, maintain and reconcile registrations, inventory and monthly reports by product type and business flow.

11

Share transactions, changes and transfers

A company-level equity transaction, private business transfer or change of control does not automatically transfer a product sanitary registration to a new entity. INVIMA explains that sanitary registration is an administrative authorisation for a specific product and authorised activities, not an ordinary business premises authorisation; a change of holder must be submitted as an application to amend the sanitary registration, accompanied by a transfer document signed by both parties, and is subject to an effective administrative decision by INVIMA.

INVIMA’s current application page lists changes to the holder/importer’s address or name, a change to the manufacturer’s address, and the addition, exclusion, change or transfer of an importer as separate matters requiring amendment of the sanitary registration. The Bogotá retail pharmacy guidance requires changes in that city to be reported within 15 working days after implementation; this period is only a local example for Bogotá. Changes to premises location, technical director, GMP conditions and controlled-drug registration should be confirmed separately with the relevant authorities.

— During transaction due diligence, take stock individually of premises authorisations, GMP, each product registration, importers, controlled-drug registrations and professional responsible persons.

— Before implementing changes, check the required INVIMA amendments, local notifications, GMP condition notifications and controlled-drug updates.

— Maintain a version history of company existence/representation documents, authorisations, manufacturer declarations, transfer agreements and submission receipts.

12

Product registration and cross-border authorisations

A medicine sanitary registration is an administrative authorisation issued by INVIMA for a specific product and its authorised activities, and must be distinguished from premises authorisation. A new product requires an IUM application; the medicine sanitary registration covers matters including the holder, product, manufacturer, importer and sales conditions. Only the registration holder may apply to amend a medicine sanitary registration.

Ordinary imports must first be matched to the product sanitary registration and applicable import procedure; import/export permits or pre-clearance registrations managed by INVIMA are processed through VUCE and should be completed before the goods arrive and are nationalised. Essential medicines in short supply, samples, donations and similar cases are subject to special authorisations. Exports must also comply with destination-country requirements; upon application, INVIMA may issue a certificate of free sale, a certificate for export purposes or a WHO-format certificate for pharmaceutical products.

Controlled drugs are not a natural extension of ordinary pharmaceutical import or retail authorisation. Import, manufacturing, nationwide wholesale, retail distribution and dispensing each have separate controlled-drug registration arrangements; wholesale registration is generally handled by FNE, while retail/dispensing registration is generally handled by the local controlled-drug authority.

— Create a product list covering registration number, holder, manufacturer, importer, IUM, pack size, storage conditions and sales restrictions.

— Before importing, verify that the product registration, VUCE permit/pre-clearance, customs documents and importer identity are consistent with one another.

— Before exporting, verify destination-market access and customer requirements, as well as the relevant certificate available from INVIMA.
