Q65 · Category B: Licence types and scope of application (Q51-Q100)
Yes, this is absolutely required. Under Hong Kong law, the definition of “manufacture” of pharmaceutical products is broad. It includes not only the process of synthesising or mixing raw materials into a finished dosage form, but also all forms of packaging, repackaging, labelling and relabelling. Even if you only subdivide unpackaged finished medicines (such as bulk tablets) or add localised Chinese labels to already packaged medicines, these activities are considered part of “manufacture”. You must therefore apply for and hold a valid Manufacturer of Pharmaceutical Products Licence, and your premises and processes must fully comply with GMP standards.

📘 Regulatory basis

The definition of “manufacture” in the Pharmacy and Poisons Ordinance (Cap. 138) covers all processes that alter, package or label medicines. The Department of Health’s GMP guidelines also expressly state that activities such as secondary packaging constitute regulated manufacturing activities.

📗 Drew Tang's recommendations

For many small and medium-sized importers, establishing a fully GMP-compliant packing area to meet local labelling requirements is very costly. A more cost-effective compliant solution is to outsource packing to a local third-party contract packager holding a Manufacturer of Pharmaceutical Products licence. We can recommend and audit qualified partners and assist with drafting a compliant quality agreement.

📕 Risk notice

Repackaging or relabelling medicines at any premises without a Manufacturer of Pharmaceutical Products licence, such as an ordinary office or warehouse, is unlawful manufacturing. The Department of Health has zero tolerance for such unlawful activities. If discovered, it will immediately take enforcement action, seize all related products and prosecute.
