The regulatory authority’s requirements for the qualifications of a ‘Responsible Person’ (RP) combine principle-based assessment with flexibility. There is no absolute quantitative standard; each case is assessed individually. PPB guidance states that an RP should have appropriate qualifications and experience. In practice, a Hong Kong registered pharmacist is the ideal candidate, as their qualifications are almost certain to be recognised. If the candidate is not a pharmacist, they will need to demonstrate sufficient relevant experience and knowledge of the pharmaceutical industry. This generally means: 1) a degree in a relevant subject, such as pharmacy, pharmacology or biochemistry; 2) several years’ work experience in pharmaceutical wholesale, manufacturing or quality management, particularly in a management role; and 3) familiarity with Hong Kong pharmaceutical regulations and GSDP (Good Storage and Distribution Practice). When applying, you will need to submit the RP’s detailed CV, academic qualifications and evidence of previous employment for the Department of Health to assess.

📘 Regulatory basis

The Code of Practice for Wholesale Dealers requires licence holders to appoint a person-in-charge and ensure that they have the appropriate qualifications, experience and knowledge to discharge their duties effectively. The PPB Board makes the final determination on whether the nominee is “fit and proper” when considering the application.

📗 Drew Tang's recommendations

Adding value to an RP candidate’s CV is one of our specialities. We will guide you in drafting the RP’s CV to highlight experience relevant to pharmaceutical quality management and regulatory compliance, rather than making general statements. We will also provide the RP with intensive pre-appointment training to ensure that, when responding to inspectors’ questions, they can demonstrate a thorough understanding of GSDP and Hong Kong regulations, thereby gaining the regulatory authority’s confidence.

📕 Risk notice

The greatest risk is appointing someone to a role beyond their capabilities. For example, appointing an RP with sales experience but no quality management background, or a newly graduated pharmacy student with no practical experience. Even if their stated qualifications appear relevant, their lack of knowledge and experience may become apparent during an in-depth discussion with inspectors, potentially becoming a key reason for delay or refusal of the application.
