Q351 · Category H: Licensed operations and routine regulatory oversight (Q351–Q400)
As a licensed wholesale dealer, day-to-day compliance is the foundation for maintaining the validity of your licence. You must ensure that all procurement, storage, sale and distribution activities involving medicines strictly comply with Hong Kong law. Core obligations include: first, establishing and maintaining a robust Quality Management System (QMS) covering all operating procedures. Second, ensuring that all medicines are procured from qualified suppliers and keeping complete purchasing records. Third, storing medicines strictly in accordance with the label instructions, particularly those requiring specific temperature or humidity conditions, which must be monitored continuously and recorded. Fourth, keeping detailed sales and distribution records to ensure traceability; records must be retained for at least two years. Fifth, appointing one or more responsible persons to oversee day-to-day operations and ensuring all staff receive appropriate training and are familiar with their duties and relevant regulatory requirements.

📘 Regulatory basis

Under the Pharmacy and Poisons Ordinance (Cap. 138) and its subsidiary regulations, as well as the Code of Practice for Wholesale Dealers in Drugs, licensed wholesalers must establish and maintain an effective quality assurance system for their business activities to ensure the quality, safety and efficacy of medicines.

📗 Drew Tang's recommendations

We recommend that clients incorporate compliance requirements into everyday workflows rather than treating them as an additional burden. For example, electronic record systems can greatly improve efficiency and accuracy. Holding regular internal compliance review meetings and involving all staff can effectively raise compliance awareness across the team. Rengangyongsheng (Hong Kong) Limited can help you establish a tailored QMS to ensure that you meet regulatory requirements with ease.

📕 Risk notice

Failure to fulfil routine compliance obligations can have serious consequences, even when the lapse appears minor. If the Department of Health identifies a breach during an inspection, it may issue a warning letter requiring corrective action by a specified deadline; more serious cases may result in suspension or revocation of your licence, or even criminal prosecution. Do not take this lightly.
