Public-source verification2026-10-31

Retail sale, wholesale and manufacturing of human medicines in Ecuador are not covered by a single, generic “pharmaceutical licence.” Pharmacies, pharmaceutical distributors and pharmaceutical manufacturers must each obtain an ARCSA health operating permit; manufacturing also requires a GMP/BPM certificate, and storage, distribution and transport activities must comply with good practices (BPADT). Product health registration, controlled-drug authorisation, shipment-specific import/export authorisations, and the individual qualifications/registration of the technical manager are dealt with separately. This guide was prepared by Rengangyongsheng (Hong Kong) Limited and explained by business manager Tang Shangyong (Drew Tang). Drew Tang is an independent third-party project coordination service provider, not an Ecuadorian pharmacist, regulator or professional in general practice in Ecuador. He does not guarantee approval, a fixed timeline or expedited processing.

This article covers pharmaceutical business licensing matters based on local public sources. Separate requirements may apply to retail, wholesale, manufacturing, product registration, imports and exports, and local rules; cross-check against the competent authorities’ current requirements before proceeding with a project.

Quick comparison of 3 types of business activity

Warehousing, distribution and transport are additionally governed by the phased implementation plan and specific rules for BPADT.The premises must have a technical manager as required by the activities. The national official materials accessed for this review did not provide a single, uniform list of educational or experience requirements applicable to all wholesalers; requirements for pharmacy or pharmaceutical plant positions must not be mechanically applied.
Pharmaceutical plant health operating permit and GMP/BPM certificate (Permiso de Funcionamiento + Certificado de BPM)Manufacturing of ordinary medicines within Ecuador, contract manufacturing, packaging and processing, and storage, distribution and transport within the scope of the permit/certification. Whether storage and transport services may be provided to third parties must be confirmed against the scope of the operating permit or GMP certificate.ARCSA: The operating permit is obtained under ARCSA-DE-2023-001-AKRG; GMP/BPM certification for domestic pharmaceutical plants, including renewal, extension and certificate amendments, is handled under ARCSA GMP service procedures and inspection guidelines.GMP application materials include the technical director's contract, registered with the labour authority. The operating permit also requires a technical manager appropriate to the activities of the premises. Individual qualifications, an employment contract and a business permit are not interchangeable.

01

Scope and entities / foreign investment

This record focuses on private pharmacy retail, pharmaceutical wholesale distribution and domestic manufacturing/contract manufacturing of ordinary human medicines in Ecuador. Health operating permits for premises, manufacturing GMP/BPM certificates, product health registration, controlled-drug authorisation, shipment-specific import/export authorisations for controlled drugs, and the individual qualifications of professionals are distinct layers and must not be conflated as a single, generic pharmaceutical licence.

Article 28 of ARCSA-DE-2023-001-AKRG allows domestic or foreign natural persons, legal entities, owners or legal representatives located in Ecuador to apply for a health operating permit before starting activities. However, before applying, they must have an RUC with active status, premises with open status, and meet the relevant category and specific rules. The article does not support treating company incorporation or general investment compliance as equivalent to authorisation to operate a pharmaceutical business.

— Retail: Private pharmacy operating permit alongside pharmacy good-practice and technical-manager requirements.

— Wholesale: Distributor operating permit alongside BPADT storage/distribution/transport compliance.

— Manufacturing: Operating permit, GMP/BPM certificate and product health registration are all required.

02

Authorities and legislation

ARCSA is the national regulator and processing authority for the three business pathways covered by this record. It is responsible for operating permits, pharmacy oversight, GMP/BPM, BPADT, ordinary medicine health registration, pharmacovigilance and procedures related to controlled drugs. The Ministry of Public Health is the national health authority; Articles 130 to 132 of the Organic Health Law provide the legal basis for operating permits, good practices and control of regulated products.

ARCSA provides application and document collection services through its headquarters and Coordinaciones Zonales. The national health documents accessed did not indicate that pharmacies, distributors or pharmaceutical plants are subject to different principal operating-permit systems by province. Municipal, fire-safety, zoning, construction or environmental matters for a specific shop or plant are outside the scope of this review of national health permits.

— ARCSA: Regulation of premises, good practices, products, inspections and controlled drugs.

— MSP: Authority at the level of national health law and the health system.

— VUE/ECUAPASS: Electronic submission channels designated by ARCSA for certain procedures; they do not replace ARCSA's approval authority.

03

Pharmacies / retail

Private pharmacies must obtain an ARCSA health operating permit before commencing operations. The permit authorises the pharmacy, according to its category, to dispense and retail authorised products to the public, and is valid for one calendar year. After issuing the permit, ARCSA may inspect the application materials and actual conditions under its risk-based plan. Pharmacies must comply with good pharmacy and dispensing practices and have suitable facilities.

A pharmacy must appoint a chemical pharmacist or biochemist pharmacist as its technical director. The rules also require continuous daily opening for at least 12 hours on working days and compliance with the applicable schedule. Pharmacies located in shopping centres, supermarkets or grocery stores are subject to the scheduling exception specified in the rules, but are not thereby exempt from the operating permit, technical director or premises requirements. A botiquín is permitted only in rural areas without a pharmacy; it may not be established in an urban area.

— Sell/dispense only products with a valid health registration, compliant labelling and an unexpired shelf life.

— Prescription medicines must not be sold without a prescription; controlled drugs must be handled using special prescriptions and in accordance with the applicable reporting mechanism.

— The limits on products a pharmacy may handle are established by the specific rules and confirmed by the actual permit; before adding products in a different category, check whether an additional permit is required.

04

Wholesale

A pharmaceutical distributor must include its business in its ARCSA health operating permit. The general rules require activities to be consistent with the company's constitutional documents or the activities declared in its RUC. Before applying, it should have a valid RUC, an opened premises, an appropriate technical director, the ARCSA checklist and the premises-specific documentation. ARCSA uses a process involving application through the system, payment and subsequent inspection.

Wholesale storage, distribution and transport must comply with BPADT. ARCSA's gradual implementation plan service covers public and private pharmaceutical establishments that store, distribute or transport ordinary medicines and other products. It requires an application before implementation of the standards, with the operating permit number, address, legal representative details and technical director details. Once approved, the plan is valid for up to 24 months. The plan is not a substitute for product health registration or qualification to handle controlled drugs.

— Confirm that distribution, storage, transport and any third-party logistics activities are all covered by the operating permit and quality system.

— Keep records of receipt, storage, dispatch, returns, recalls, contractors, and temperature-control/transport quality for subsequent oversight.

— If controlled drugs are to be handled, obtain a separate calificación for non-pharmacy premises in accordance with ARCSA guidance.

05

Manufacturing

At a minimum, the compliance pathway for a domestic pharmaceutical manufacturer includes an ARCSA health operating permit and a GMP/BPM certificate. ARCSA's GMP service page covers pharmaceutical laboratories in Ecuador that manufacture, contract manufacture, package, handle, store, distribute or transport ordinary medicines, medicines containing controlled drugs, biological products, radiopharmaceuticals, active pharmaceutical ingredients and investigational products. Manufacturing ordinary human medicines also requires the relevant product health registration to be valid.

GMP applications, renewals and extensions are handled through ARCSA's GMP system. Publicly available information lists documents including the inspection guide, site location, product list, organisational chart, technical director's employment contract registered with the labour authority, laboratory master file, validation master plan, transport vehicles and qualified outsourced storage and transport contracts. New dosage forms, production areas, equipment or outsourcing arrangements must be assessed against the scope of the GMP certificate and the change-control procedure.

— Health operating permit: applicable to the RUC, address and activities at the premises.

— GMP/BPM: applicable to production areas, dosage forms, equipment, quality system, technical director and transport/outsourcing scope.

— Product level: applicable to each product's health registration, labelling, stability and post-market responsibilities.

06

Professional personnel

The technical director of a private pharmacy must be a chemical pharmacist or biochemist pharmacist. Following the 2023 amendment to the specific pharmacy rules, that professional may be responsible for up to three pharmaceutical establishments, subject to actual workload and working hours. A narrower concurrent-role arrangement applies where the pharmacy owner is that professional. This is a specific rule for pharmacies in Ecuador, not a general “pharmacist coverage ratio” requirement.

The general operating permit rules require premises engaged in manufacturing, commercialisation, storage, distribution, transport or dispensing to have a technical director as required. GMP documentation for pharmaceutical laboratories also includes the technical director's employment contract. Technical directors involved in pharmacy renewals must also meet MSP/ACESS registration requirements. The individual's qualifications/registration, appointment contract and business permit should be verified separately.

— Pharmacy: verify the professional designation, technical director's contract, working hours and MSP/ACESS registration.

— Distribution: appoint a technical director according to the actual business activities; do not apply pharmacy or pharmaceutical laboratory role standards without a basis.

— Manufacturing: prepare evidence of the technical director's contract, organisational structure, assigned responsibilities and GMP quality system.

07

Premises and facilities

A pharmacy must have suitable infrastructure and clearly designated, separate areas for medicine storage and sales. Distributors must ensure that storage, distribution and transport comply with BPADT. Pharmaceutical laboratories must demonstrate, through the GMP inspection guide, master files, validation and equipment/system controls, that their premises are suitable for the authorised activities. National official materials do not specify a minimum floor area, capital amount or fixed construction standard that can safely be applied to all pharmacies, warehouses and pharmaceutical laboratories.

Permit documents state the premises' precise address, activities, RUC and responsible persons, among other details. A change of address, storage/transport methods, production areas or equipment may affect the operating permit, GMP/BPM, product documentation and contractual arrangements at the same time. Assess the impact across all documents before implementing any change.

— Pharmacy: separate storage/sales areas, good pharmacy and dispensing practices, prescription and inventory controls.

— Wholesale: storage, distribution and transport suitable for the products, contractors and traceability records.

— Manufacturing: production areas, equipment, validation, critical utility systems, vehicles and contract givers must be consistent with the scope of the GMP certificate.

08

Documentation and procedures

For a general premises application, first confirm that the RUC is valid, the registered premises have been opened, the business classification is in place (if applicable), and the activities are consistent with the RUC/company objects. Then complete the single form in ARCSA's permit system, accept the declaration terms, complete the checklist and attach the specific documents. ARCSA generates a payment order; the accuracy of the information is verified during document review and subsequent oversight. Pharmaceutical establishments must also submit documentation establishing a pharmacovigilance unit or a contract with a health professional who will perform that function.

A first-time pharmacy application must additionally submit the technical director's employment/professional services contract through the specific system process. Pharmaceutical laboratories follow a separate GMP system and audit procedure. Typical documents include the GMP inspection guide, location details, product/vehicle lists, organisational chart, technical director's contract, master files, validation plan and outsourcing documentation. Health registration for ordinary products is submitted separately through VUE and cannot be combined with the premises application as a single procedure.

— First define the establishment type, actual activities, product categories, whether controlled drugs are involved and whether there will be cross-border movement.

— Then prepare separate documentation for the operating permit, BPADT/GMP, pharmacovigilance, product health registration and import/export.

— After submission, address ARCSA requests for corrections, subsequent inspections and audit findings. Do not interpret automated issuance as an exemption from review.

Fees, timeframes and validity periods

Health operating permits for pharmacies, distributors and pharmaceutical laboratories are generally valid for one calendar year and should be renewed through the ARCSA system 30 days before expiry. Fees must be confirmed against ARCSA's applicable fee schedule at the time, the system payment order, the activity category and application scope. No single fee figure or uniform overall approval period has been identified that can safely be applied to all establishments.

ARCSA's GMP service page currently lists 12.5 SBU for obtaining/renewing a GMP certificate for a domestic pharmaceutical laboratory and 8 SBU for extending areas. These are not prices for all premises permits, product registrations or controlled-drug services; the actual amount still depends on the SBU in effect and the official payment arrangements. Product health registrations are valid for five years; this is the validity period for a product, not a premises permit.

— Operating permit: one calendar year; renew 30 days before expiry.

— Product health registration: five years; renew the registration in accordance with the product rules.

— GMP/BPM, BPADT, controlled-drug services and product procedures: confirm according to the specific service, scope and current payment order; no fixed timeframe is guaranteed.

10

Operations, renewal and GMP/GDP

After an operating permit is issued, the premises remain subject to ARCSA’s subsequent oversight. The business should maintain consistency between the activities, address, responsible person and RUC stated in the permit and its quality system and actual operations. When renewing the permit for a pharmaceutical laboratory or other pharmaceutical premises, evidence of pharmacovigilance/technical vigilance activities must be provided; pharmacy renewals must also meet the requirements concerning the technical manager’s contract, medicine price reporting and, where applicable, antimicrobial records.

Pharmacies must continue to comply with dispensing and prescription/inventory rules; wholesalers must continue to comply with BPADT; and manufacturers must continue to comply with GMP and controls covering validation, equipment, the technical director, outsourcing and transportation. ARCSA may conduct inspections according to health-risk plans or whenever it considers them necessary; therefore, the absence of a permit suspension does not mean there are no ongoing maintenance obligations.

— Annual check: permit expiry date, RUC status, activities, address, responsible person, contact details and fees payable.

— Quality check: pharmacovigilance, temperature control/storage and transport, deviations, returns, recalls, destruction and outsourced-provider qualifications.

— Retail check: pharmacy operations, medicines/prescriptions, controlled drugs and price/antimicrobial reporting.

11

Share transactions, changes and transfers

Article 40 of ARCSA-DE-2023-001-AKRG requires modifications, extensions and additions to pharmaceutical premises to be processed through the licensing system; Article 41 specifies that changes to the RUC, category, address (except a change in naming only), or activities, or deletion of an activity, require a new operating permit. The specific pharmacy rules also treat changes to the legal representative, technical manager, address naming and company name under the same RUC as modifications, while changes to the RUC, relocation and category require a new permit.

GMP certificates for manufacturing have a separate change procedure. ARCSA’s GMP service page lists changes to the RUC arising from a change in the natural or legal person, sale and purchase, or assignment of rights; the relevant transaction or succession documents and the new RUC must be submitted. Specific documentation is also required for changes to the technical manager, technical director, legal representative, address naming, scale, equipment, vehicles and outsourced transport. Changes to the product registration holder, manufacturer, labelling and other product details are handled separately under the product registration amendment/notification procedure.

— First determine whether the transaction or project changes the RUC, address, category, activities, legal representative, technical manager, technical director or product registration holder.

— Separately assess the consequences of the change for the operating permit, GMP/BPM, BPADT, product sanitary registration and controlled-drug qualification.

— Before closing/relocation, retain written confirmation from ARCSA or evidence of receipt/approval through its system.

12

Product registration and cross-border authorisations

Sanitary registration of ordinary human medicines is governed by ARCSA-DE-2024-058-DASP and the 2025 guidance IE-B.3.2.1-MG-01. Product applications are submitted through VUE in ECUAPASS and processed item by item under rules including dosage form, active ingredient concentration and finished dosage. Once product registration is issued, the applicant becomes the holder and assumes legal and technical responsibility for quality, safety and efficacy. Registration is valid for 5 years and must be renewed by reinscripción upon expiry; if renewal is not filed in time, the product may not continue to be imported, exported or commercialised under the original certificate.

Product sanitary registration does not replace an operating permit or GMP. An application for registration of an ordinary medicine requires a valid operating permit and, depending on the product type, GMP, manufacturer, stability, quality, labelling, package leaflet and any required authorisation documents. Product-level changes, such as changes to the label, holder or manufacturer, are handled separately under the registration amendment or notification procedure. Requirements for legalisation of foreign GMP certificates/pharmaceutical certificates and documents for imported products should be verified item by item against the current product guidance.

Cross-border movement of medicines containing controlled substances has additional independent requirements. An operating permit for pharmaceutical premises other than a pharmacy is not equivalent to controlled-drug calificación; even after obtaining the relevant qualification, importers and exporters must apply for ARCSA authorisation before each shipment. Imports use VUE; exports are currently submitted, as described by ARCSA, to its headquarters or regional coordination offices. Requirements should be checked according to application type, including documents such as invoices, destination-country import certificates and proof of payment.

— Products: the holder manages sanitary registration, renewal, amendments, labelling/package leaflets and pharmacovigilance.

— Imports/exports: in addition to product registration and applicable operating permit/GMP requirements, verify each case according to origin, product category, documentation and customs route.

— Controlled drugs: neither premises qualification nor prior authorisation for each import/export shipment may be omitted.
