Q219 · 我是否需要为我的药品仓库购买特定的保险?这在申请时需要提交证明吗?独立链接
At the licence application stage for various pharmaceutical licences in Hong Kong, neither the Department of Health nor the PPB requires you to provide proof that you have purchased specific insurance. In other words, insurance is not a required document for submitting an application. However, from the perspective of prudent business management and risk control, it is essential to obtain adequate insurance for your medicine warehouse and business, and this is something the regulatory authorities are likely to welcome. Recommended types of insurance include: property all-risks insurance (covering losses to your medicine inventory caused by incidents such as fire or theft); public liability insurance (covering the risk of personal injury or property damage caused to third parties by your business activities); and product liability insurance (covering the risk of harm to users caused by defects in the medicines you sell). Although you do not need to submit proof with your application, being able to show during an on-site inspection that you have planned for or purchased relevant insurance would be a positive point if the inspector asks about your risk management measures.

📘 Regulatory basis

The Code of Practice for Wholesale Dealers requires licence holders to have appropriate arrangements for managing risks, but does not expressly prescribe what commercial insurance must be purchased. This is a business decision, but a responsible operator should have such arrangements in place.

📗 Drew Tang's recommendations

We strongly recommend that all clients have a comprehensive insurance plan in place before commencing operations. Rengangyongsheng (Hong Kong) Limited can connect you with experienced insurance brokers, who can tailor a cost-effective insurance package to your business scale and product types. We can include a section on “Insurance and Risk Management” in your application SOP documents to demonstrate to the regulatory authorities that you have considered these matters carefully and professionally.

📕 Risk notice

The greatest risk is operating “without a safety net”. If an accident occurs, such as a warehouse fire destroying pharmaceutical inventory worth millions, or a medicine-related issue leads to substantial claims, the financial consequences of having no insurance will be catastrophic and may directly result in the company's bankruptcy. Do not expose the entire business to substantial risk just to save on premiums in the short term.

Q221 · 申请“获授权毒药销售商”(药房)牌照与批发商牌照在审批程序上有何核心差异?独立链接
Applying for an “Authorised Seller of Poisons” (ASP) licence, commonly known as a community pharmacy licence, differs fundamentally from applying for a Wholesale Dealer Licence in terms of procedures and requirements. The key differences concern staffing and the function of the premises. A pharmacy must have a registered pharmacist present to personally supervise the sale of all controlled medicines, which means you must employ a full-time registered pharmacist. A wholesale dealer, on the other hand, must appoint a Responsible Person (RP). As for the premises, a pharmacy is a retail shop open to the public, and its layout, design and location should facilitate access to medicines by the public, with a dedicated dispensing area and consultation area. A wholesaler's warehouse is a non-public storage and logistics centre. As with a pharmacy application, the approval process involves an on-site inspection by the Department of Health and approval by the PPB committee, but the inspection focuses more on compliance in retail operations, the pharmacist's presence and the management of prescription medicines.

📘 Regulatory basis

The Pharmacy and Poisons Regulations have a dedicated section setting out the operating conditions for Authorised Sellers of Poisons, including the requirement for supervision by a registered pharmacist. The Code of Practice for the Guidance of Pharmacy issued by the PPB provides detailed guidance for retail operations.

📗 Drew Tang's recommendations

For clients planning to open a pharmacy, our first recommendation is “people before premises”: secure a registered pharmacist to work with you first. An experienced and reputable pharmacist is key to a successful application. We can assist with recruitment and background checks, and design and fit out your shop in accordance with the pharmacist’s professional advice, ensuring that the layout complies with regulations and is practical to operate.

📕 Risk notice

The greatest risk is the stability of the pharmacist. If your pharmacist leaves during the application process or shortly after approval, and you cannot find a replacement immediately, your licence application may be suspended. A pharmacy that has already opened must also immediately stop selling all controlled medicines; otherwise, it would be operating unlawfully, with very serious consequences.

Q224 · 在初次提交申请时,我的标准操作程序(SOPs)需要准备到多详细的程度?独立链接
You do not need to submit a perfect final set of SOPs covering every detail with your initial application. However, you must prepare a core set of clearly structured draft SOPs to demonstrate to the regulator that you have systematically considered and planned your future operational processes. These drafts should cover at least all key areas of GSDP (Good Storage and Distribution Practice), including personnel and training, premises and equipment management, document control, receipt, storage, order processing, dispatch, transport, complaint handling, medicine recalls, returned goods handling and internal audits. Each SOP should have a clear title, purpose, scope, allocation of responsibilities and description of steps. During an on-site inspection, inspectors will sample these SOPs and may ask your Person-in-Charge about the procedures they describe to assess whether your quality management system is tangible and effective.

📘 Regulatory basis

The Code of Practice for Wholesale Dealers expressly requires licence holders to establish and maintain an effective Quality Management System, with SOPs as its core documentary evidence. Inspectors need to review your SOPs to assess your ability to ensure ongoing compliance.

📗 Drew Tang's recommendations

We will not leave you to start from scratch. RGYS may assist with document preparation and project coordination within the written scope of services; the respective responsible parties must verify personnel qualifications and statutory roles and take responsibility for professional judgements, while approval is determined independently by the competent authority. Based on your specific business model (for example, whether you handle cold-chain products), we will customise a set of draft SOPs to meet your needs. These documents can not only readily pass the initial review but, more importantly, are highly practical and can genuinely guide your future day-to-day work, rather than merely serving to satisfy inspections.

📕 Risk notice

The risk lies in submitting SOPs copied from the internet that are hollow and unrealistic. For example, the processes described may not match your warehouse layout, or the wrong terminology may be used. An experienced inspector will immediately recognise that the document is “theoretical” and may seriously question your professional competence and the sincerity of your application, resulting in unusually rigorous scrutiny.

Q228 · 对于需要冷链运输的药品,在申请牌照时,对仓库和流程有何特殊要求?独立链接
Handling drugs requiring cold-chain management (such as vaccines and biologics) imposes far stricter requirements on warehouse facilities and operating procedures than handling ambient-temperature drugs. When applying for a licence, you must demonstrate to the Department of Health that you have full cold-chain management capabilities. For the warehouse, you must have dedicated, validated refrigeration equipment (usually refrigerators or cold rooms maintained at 2–8°C). This equipment must have an independent, continuous temperature and humidity monitoring and recording system with an alarm function. Your SOPs must contain dedicated sections describing in detail the entire process for receiving, storing, picking, packing and transporting cold-chain products. You must use validated refrigerated transport containers and data loggers, and ensure that the temperature remains within the required range at every stage from your warehouse to the customer. During an on-site inspection, inspectors will examine your cold-chain facilities and procedures in great detail.

📘 Regulatory basis

The Code of Practice for Wholesale Dealers published by the PPB and the PIC/S GSDP Guide both include detailed requirements for the storage and transport of temperature-sensitive medicines. These are the main standards regulators use to assess your cold-chain capabilities.

📗 Drew Tang's recommendations

We recommend that clients planning to handle cold-chain products invest in establishing a robust cold-chain system at the outset of the project. We will recommend reliable equipment suppliers and validation service providers, and draft a world-class set of cold-chain management SOPs for you. We will also guide you through transport validation to ensure that your cold-chain logistics solution is robust and can withstand the regulator’s most stringent scrutiny.

📕 Risk notice

The greatest risk is a “fake cold chain”. For example, using a domestic refrigerator to store vaccines, or using ordinary ice packs during transport without a validated refrigerated container and temperature records. A temperature excursion at any stage may render the medicine ineffective and pose a serious safety risk to patients. If such a problem is found during an inspection, your licence application will be refused immediately.

Q229 · 如果我只计划批发一种风险极低的非处方药(OTC),申请要求会因此而放宽吗?独立链接
This is a matter where the boundary must be absolutely clear. Before you formally obtain a pharmaceutical licence issued by the PPB, you must not carry out any business activity within the scope of the licence. Specifically, you must not import, export, wholesale, sell, distribute or store any pharmaceutical products. Any of these activities would constitute operating without a licence, which is a serious criminal offence. However, preparatory business activities that do not involve actual transactions in pharmaceutical products are permitted. For example, you may conduct market research, design your company website (but not sell pharmaceutical products online), make initial contact with potential suppliers or customers, discuss a framework for cooperation, or even sign a non-legally binding letter of intent (LOI) or memorandum of understanding (MOU), provided that the documents clearly state that all cooperation can only proceed once you have formally obtained the licence.

📘 Regulatory basis

Neither the Pharmacy and Poisons Ordinance nor the Code of Practice for Wholesale Dealers establishes different licence grades or application requirements for medicines with different risk levels. All applicants must meet the same GSDP (Good Storage and Distribution Practice) standard.

📗 Drew Tang's recommendations

Although the application standards are not reduced, we can design a more cost-effective compliance solution to suit your simple business model. For example, your premises may be relatively small and your SOP processes may be relatively straightforward, such as not involving complex recall or complaint-handling procedures. We will help you find the most economical operating model while remaining fully compliant, avoiding over-engineering and matching your initial investment to the scale of your business.

📕 Risk notice

The risk lies in the mistaken expectation that “requirements will be relaxed”, leading to carelessness in preparation. For example, you might assume that a low-risk product means you can simply rent an office as a warehouse, or let a company administrator double as the person responsible. This would put you on the wrong track from the very first step of the application, wasting considerable time and resources.

Q231 · 我是否可以委托第三方物流公司(3PL)来储存和运输我的药品?如果可以,申请流程有何不同?独立链接
Yes, you may outsource medicine storage and/or transport to a suitably qualified third-party logistics provider (3PL). This is a very common business model in the industry, particularly for companies seeking to operate an asset-light business. If you choose this approach, your application process will change significantly. You will no longer need to lease and fit out a medicine warehouse yourself. Instead, you will need to enter into a detailed service contract with a 3PL company that already holds a valid Wholesale Dealer Licence for medicines. You must submit this contract with your licence application and clearly define the responsibilities of your company and the 3PL. You will still need to establish a Hong Kong company and appoint an RP, but the RP's main responsibility will shift from managing a physical warehouse to overseeing and auditing the 3PL's service quality, ensuring that its operations comply with GSDP requirements and your company's SOPs. The Department of Health may conduct on-site inspections at your office and the 3PL's warehouse, either at the same time or separately.

📘 Regulatory basis

The Code of Practice for Wholesale Dealers has a dedicated section on “Outsourced Activities”. It expressly provides that the licence holder (that is, you) retains ultimate responsibility for any outsourced activity, must ensure that the contractor (3PL) is capable of providing compliant services, and must effectively oversee it.

📗 Drew Tang's recommendations

Choosing a reliable 3PL partner is crucial. RGYS may assist with document preparation and project coordination within the written scope of services; the respective responsible parties must verify personnel qualifications and statutory roles and take responsibility for professional judgements, while approval is determined independently by the competent authority. We will assist you in conducting due diligence, selecting the partner best suited to your business needs, and drafting a Technical Agreement that clearly defines rights and responsibilities and meets regulatory requirements. This agreement will be one of the key documents for the success of your application.

📕 Risk notice

The greatest risk is thinking that outsourcing everything will solve the problem. If you believe you can relax once logistics have been outsourced, you are seriously mistaken. If your 3PL partner is found to have committed serious breaches during a subsequent inspection, you, as the commissioning party and licence holder, may also be legally liable, and your licence may likewise be suspended or revoked. Ongoing supplier audits and quality oversight are therefore essential.

Q233 · 卫生署的药剂师督察在进行现场视察时,是否有固定的检查清单(checklist)?独立链接
Yes, during on-site inspections, Department of Health pharmacy inspectors assess the premises against a detailed internal checklist. The checklist is based on the Pharmacy and Poisons Ordinance and relevant codes of practice (such as the Code of Practice for Wholesale Dealers) and covers all requirements that licence holders must meet. It includes item-by-item checks of the physical conditions of the premises (such as area, layout, security and temperature and humidity controls), facilities and equipment, the Quality Management System (QMS) (including the completeness and practicability of SOPs), document and record management (such as batch records and temperature and humidity records), personnel qualifications and training records, and specific procedures (such as receipt, storage, picking, dispatch and recall). Although this internal checklist is not published, all its inspection points are derived from published legislation and guidance. An experienced consultant can therefore accurately predict most of its contents.

📘 Regulatory basis

The inspection checklist is an internal tool used by the regulatory authority to ensure that its inspections are standardised, systematic and fair. Its legal basis is the power conferred on Department of Health inspectors by the Pharmacy and Poisons Ordinance to enter and inspect licensed premises.

📗 Drew Tang's recommendations

One of our core strengths at RGYS: RGYS may assist with document preparation and project coordination within the written scope of services; the respective responsible parties must verify personnel qualifications and statutory roles and take responsibility for professional judgements, while approval is determined independently by the competent authority. RGYS may assist with document preparation and project coordination within the written scope of services; the respective responsible parties must verify personnel qualifications and statutory roles and take responsibility for professional judgements, while approval is determined independently by the competent authority. Before the official inspection, we will use this checklist to conduct a "pixel-level" mock audit of your premises and documents, identifying and correcting all potential issues to ensure that, when you face the actual inspector, RGYS may assist with document preparation and project coordination within the written scope of services; the respective responsible parties must verify personnel qualifications and statutory roles and take responsibility for professional judgements, while approval is determined independently by the competent authority.

📕 Risk notice

The risk lies in misjudging the scope of an inspection. Some applicants may focus only on warehouse facilities and overlook the importance of “soft” elements such as records and staff training. Inspections are comprehensive, and a deficiency in any area may result in failure. For example, even if your cold room is state of the art, the inspection result will inevitably be unsatisfactory if you cannot produce a complete temperature validation report.

Q237 · 如果我计划搬迁我的药品仓库地址,需要履行什么审批程序?独立链接
If you plan to relocate your pharmaceutical warehouse, this is a major change and you must not simply “move first and report later”. You must treat it as a new “mini” licence application. The correct procedure is as follows: first, preferably have a professional consultant assess the new premises for compliance before signing a tenancy agreement. You then need to submit a formal “Change of Premises” application to the Drug Office, Department of Health. This application must include detailed plans of the new premises, the tenancy agreement and a statement explaining why relocation is necessary. The Department of Health will conduct a full on-site inspection of the new premises as it would for a new application. You may only start moving medicines to the new address after the new premises has passed inspection and you have received formal written approval from the Department of Health for the change of address. Until approval is granted, you must continue operating at your existing licensed address.

📘 Regulatory basis

Your medicine licence is tied to a specific licensed address. Storing or wholesaling medicines at an unapproved address is equivalent to operating without a licence. The Code of Practice for Wholesale Dealers also expressly requires prior approval from the Department of Health for any significant change to the premises.

📗 Drew Tang's recommendations

We will manage the entire relocation process for you. From selecting the new premises and designing the layout plan to submitting a change application to the Department of Health and preparing the new premises for an on-site inspection, we will support you throughout. We will also help you plan a seamless relocation to ensure that your business operations and compliance status are not affected during the transition to the new address.

📕 Risk notice

The greatest risk is “moving first and notifying later”. If you move medicines to a new address without approval, the Department of Health may immediately suspend or even revoke your licence if it discovers this. This is an absolute red line. Another risk is signing a new lease without adequate assessment, only to find that the new premises cannot meet compliance requirements, leaving you in a dilemma.

Q238 · 除了卫生署,申请药品牌照是否还需要与其他香港政府部门打交道?独立链接
In the main pharmaceutical licence application process, your primary and most direct contacts are the Department of Health (including its Drug Office or Chinese Medicine Regulatory Office) and the Pharmacy and Poisons Board (PPB). However, during the preparation and operation of your business, you may need to interact with other government departments. First, you must register the company with the Companies Registry and obtain a Business Registration certificate from the Business Registration Office of the Inland Revenue Department. Your business premises must also comply with the fire safety requirements of the Fire Services Department and the building safety standards of the Buildings Department. Although you will not normally need to apply directly to these two departments when applying for a pharmaceutical licence, Department of Health inspectors will check during their inspection that your premises have basic fire safety facilities, such as fire extinguishers and emergency exit signs, and are structurally safe. If your business involves imports or exports, you will also need to deal with Hong Kong Customs and may need to apply for relevant import or export licences.

📘 Regulatory basis

The Companies Ordinance, Business Registration Ordinance, Fire Safety (Buildings) Ordinance, Buildings Ordinance and Import and Export Ordinance, among others, are basic laws that businesses in Hong Kong must comply with and are closely related to your drug licence application and operations.

📗 Drew Tang's recommendations

We provide an integrated solution. When assessing and designing a warehouse for you, we consider not only the Department of Health's requirements, but also basic fire safety and building safety requirements, conducting a comprehensive compliance review. If your business requires it, we can also help you with customs-related import and export licensing matters to ensure that your business is lawful and compliant in all respects in Hong Kong.

📕 Risk notice

The risk lies in overlooking these “peripheral” but equally important compliance requirements. For example, your warehouse may pass inspection by the Department of Health, but if a routine inspection by the Fire Services Department finds blocked fire escape routes or expired fire equipment, you may still face a fine or an order to suspend operations for remedial work. A successful business must establish a comprehensive culture of compliance, rather than meeting the requirements of only one regulator.

Q244 · 我是否可以用一个虚拟办公室(Virtual Office)地址来注册公司和申请药品牌照?独立链接

📘 Regulatory basis

Both the Code of Practice for Wholesale Dealers and the Code of Practice for the Guidance of Pharmacy have extensive provisions on the specific physical requirements for “premises”. A virtual office clearly cannot meet any of them. The licence application form also expressly requires a physical business address.

📗 Drew Tang's recommendations

We recommend that clients clearly distinguish between the two concepts: the company’s registered address may be a company secretarial firm’s address or a virtual office selected for convenience; however, the licensed address for the medicines licence must be a fully compliant physical warehouse or shop into which you have invested heavily and made careful preparations. Ensure that these two addresses are not confused on any form.

📕 Risk notice

The risk lies in confusion about the meaning of “address”. Incorrectly declaring a virtual office address in a licence application could not only result in rejection, but also cause the regulator to question your professionalism and seriousness. This may have an unnecessary negative impact if you later reapply using a genuine address. This elementary mistake should be avoided altogether.

Q245 · 在现场视察时,除了负责人(RP),其他员工是否也可能被督察提问?独立链接

📘 Regulatory basis

The Code of Practice for Wholesale Dealers stresses the importance of ongoing training for all staff engaged in wholesale activities. Spot questions are a direct way to assess the effectiveness of training and an effective means of checking whether SOPs are “embedded in staff practice”.

📗 Drew Tang's recommendations

“Everyone is ready for action” is our training philosophy. Before an inspection, we not only provide focused guidance to your RP but also offer tailored question-and-answer training and practice sessions for all your key staff, such as warehouse supervisors and quality assistants. We ensure that when inspectors ask questions, every team member can give confident, accurate answers that fully accord with your SOPs.

📕 Risk notice

The risk is that “only the RP understands it”. If inspectors find that staff other than the RP know nothing about the SOPs, or that actual practices differ significantly from the SOPs, they may reach a very negative conclusion: that your quality system is merely a “paper exercise” created to get through inspections. This would be a major deficiency and could well result in a failed inspection.

Q247 · 我的业务包含对药品进行二次包装(Secondary Packaging),这在审批上有什么额外要求?独立链接

📘 Regulatory basis

Under PIC/S GMP guidelines, secondary packaging is considered part of manufacturing. Accordingly, such activities require explicit authorisation from the Department of Health and must comply with simplified GMP requirements, also known as “GMP-light”.

📗 Drew Tang's recommendations

If you need to carry out secondary packaging, we will plan for this specifically from the start of the project. We will design a compliant packaging room, draft a complete set of packaging SOPs and guide you on preparing batch packaging records correctly. We will ensure that, when you apply, you can clearly demonstrate to the Department of Health that you are capable of carrying out safe, compliant secondary packaging.

📕 Risk notice

The risk lies in repackaging without authorisation. If you hold only an ordinary Wholesale Dealer Licence but secretly split packs or relabel products in your warehouse, this amounts to serious unlicensed manufacturing. If discovered, the consequences will be severe: your Wholesale Dealer Licence may be revoked, and the company and persons responsible may also face criminal prosecution.

Q256 · 在香港租赁符合药物办公室检查标准的仓储或店铺,租金成本大概占总预算的多少?独立链接
Premises rent is one of the main costs of starting a pharmaceutical business. Its share of the total budget varies depending on location, floor area and licence type, but is generally substantial. Monthly rent for a licensed pharmacy in an urban area with a floor area of about 500 to 1,000 square feet can easily reach tens of thousands to over a hundred thousand Hong Kong dollars. For a wholesaler’s warehouse requiring more space and specific logistics conditions, rent is also a major expense, even in an industrial area. In the initial budget, we generally recommend allocating at least 30% to 40% of funds to cover the initial rent, deposit (typically two months’ deposit plus one month’s rent in advance) and a rent reserve for at least six months after opening.

📘 Regulatory basis

The Drug Office, Department of Health’s Guide to the Licensing of Wholesale Dealers of Pharmaceutical Products and Code of Practice for Authorised Sellers of Poisons both set out clear requirements for premises area, layout, security and environmental control (temperature and humidity). These requirements directly affect the range of properties you can choose from and their rental levels.

📗 Drew Tang's recommendations

Site selection is a key step in determining success or failure. Before signing a tenancy agreement, Rengangyongsheng recommends that clients ask us or their appointed consultant to conduct a preliminary assessment of the property and determine whether it can be adapted cost-effectively. A property that appears to have low rent but requires substantial refurbishment may have higher ‘hidden costs’.

📕 Risk notice

The greatest risk is discovering only after signing a long-term lease that the premises cannot pass the Department of Health's on-site inspection because of structural, fire safety or ventilation issues. This may leave you locked into the lease without being able to obtain a licence, creating a financial dilemma. Make passing the Department of Health inspection one of the key conditions precedent to the lease.

Q257 · 除了药剂师,我还需要聘请哪些员工?他们的人力成本如何规划?独立链接
In addition to the registered pharmacist required by law, a smoothly operating pharmacy or pharmaceutical wholesaler also needs other key staff. A pharmacy will need at least 1–2 dispensers or trainee dispensers to assist the pharmacist with handling prescriptions, managing inventory and selling non-prescription medicines. Cashiers and shop cleaning staff are also needed. A wholesaler will need warehouse staff, clerical staff responsible for order processing and logistics, and sales representatives. When preparing your budget, calculate for each employee their basic salary, Mandatory Provident Fund (MPF) contributions, employees’ compensation insurance, and potential year-end bonuses and overtime pay in accordance with Hong Kong’s employment legislation.

📘 Regulatory basis

The Employment Ordinance (Cap. 57) and the Mandatory Provident Fund Schemes Ordinance (Cap. 485) are fundamental laws that you must comply with when planning staffing costs. In addition, the Pharmacy and Poisons Board's (PPB) codes of practice require sufficient personnel with appropriate training to support pharmacy operations.

📗 Drew Tang's recommendations

We recommend considering part-time staff or more flexible shift arrangements during the initial period of operation to control labour costs. Ongoing professional training for staff is not only a compliance requirement but also a key investment in service quality and operational efficiency. A well-trained dispenser can greatly ease the pharmacist’s workload.

📕 Risk notice

An insufficient labour cost budget may reduce service quality and increase compliance risks. For example, staff shortages may leave a pharmacist unable to supervise all medicine sales effectively. Any error could result in severe disciplinary action. Breaches of the Employment Ordinance may also lead to prosecution and fines by the Labour Department.

Q263 · 申请牌照过程中,如果需要对场地进行改造,这部分的工程费用应该如何预估?独立链接
Premises renovation costs are one variable in start-up costs, and depend on the gap between the property’s original condition and the requirements of the target licence. Estimates should take account of the following key items: 1. “Heating, ventilation and air-conditioning system (HVAC)”: a separate commercial air-conditioning system may need to be installed or upgraded to meet temperature and humidity control requirements. 2. “Partitions and layout”: walls or partitions may need to be built or installed to provide functional areas (such as receiving, storage, dispensing and office areas). 3. “Power and lighting”: ensure adequate electrical load and compliant lighting. 4. “Security facilities”: including CCTV, burglar alarms and cabinets for storing hazardous materials. 5. “Floors and walls”: seamless, easy-to-clean epoxy flooring may need to be installed. Renovation costs for a small or medium-sized pharmacy or warehouse may range from tens of thousands to hundreds of thousands of Hong Kong dollars.

📘 Regulatory basis

Both the Guidelines on Licensing of Wholesale Dealers in Medicines and the Code of Practice for Authorised Sellers of Poisons set out clear requirements for the physical conditions of premises. These requirements provide the blueprint and acceptance criteria for your premises renovation and design.

📗 Drew Tang's recommendations

Before signing a lease, be sure to ask a professional adviser such as us or an experienced building contractor to inspect and assess the site. We also strongly recommend adding an additional 15% to 20% contingency allowance to your renovation budget to cover unexpected issues that may arise during construction.

📕 Risk notice

The biggest financial pitfall is starting fitting-out work without obtaining a professional assessment. If the property is ultimately found unable to meet regulatory requirements because of structural issues, such as fire safety or ventilation, all fitting-out costs may be wasted. Make “passing the Department of Health inspection” the final acceptance criterion for the works.

Q277 · 如果未来我想在香港开设分店或扩大仓库规模,在财务上需要做哪些准备?独立链接
Business expansion is exciting, but it must be built on a sound financial foundation. If you plan to open a branch or expand your warehouse, financial preparation is a priority: 1. “Evidence of profitability”: your existing business should already be consistently profitable and generate sufficiently strong positive cash flow. This gives you the financial confidence to expand. 2. “Dedicated expansion budget”: prepare a separate, detailed start-up budget for the new branch or warehouse, similar to the one for your original start-up and covering rent, renovation, staffing and new inventory. 3. “Financing plan”: identify the source of funding for the expansion—whether retained company profits, new bank loans or shareholder contributions. 4. “Risk assessment”: analyse the new risks that expansion may bring and ensure that you have sufficient reserves to cover any initial losses.

📘 Regulatory basis

Opening each new licensed premises—whether a pharmacy branch or a standalone warehouse—is equivalent to making an entirely new licence application. You must submit a separate licence application for the new address to the Department of Health or the Chinese Medicines Board and pass all inspections.

📗 Drew Tang's recommendations

We recommend a gradual, step-by-step expansion strategy. Before taking the second step, first ensure that the first shop is operating smoothly and that its management model and processes have been standardised and can be replicated successfully. Overly rapid, uncontrolled expansion is where many businesses begin to decline.

📕 Risk notice

The greatest financial risk of expansion is the “cash flow trap”. New shops or warehouses typically require ongoing funding during their initial operating period. Excessive expansion may drain the cash flow of your otherwise healthy parent company and put the entire corporate group in difficulty. Ensure that your expansion plan does not jeopardise the viability of your existing business.

Q284 · 如果我的药品批发业务需要冷链运输(Cold Chain Logistics),这会增加多少成本?独立链接
Cold-chain transport is the most costly part of pharmaceutical logistics and can significantly increase your operating expenses. The additional costs are mainly as follows: 1. “Specialist transport vehicles”: you will need dedicated vehicles fitted with refrigeration units and temperature and humidity data loggers. Their purchase and maintenance costs are far higher than those of ordinary lorries. 2. “Validation and calibration”: refrigerated vehicles and cold-chain facilities in warehouses require regular temperature mapping and equipment calibration. 3. “Packaging materials”: validated shippers and coolants must be used; these are consumables. 4. “Higher transport charges”: if you outsource to a third-party logistics company, cold-chain services typically cost 50% to 200% more than ordinary freight transport.

📘 Regulatory basis

The PIC/S GMP Guide and the Department of Health's Guidance Notes on Licensing of Drug Wholesalers impose stringent requirements on the storage and transport of medicines requiring temperature control, such as vaccines and biological products, including uninterrupted temperature records throughout the supply chain.

📗 Drew Tang's recommendations

For start-ups with low business volumes, we do not recommend setting up your own cold chain fleet. A more cost-effective and efficient approach is to work with one or two reputable specialist third-party cold chain logistics companies with GDP certification. This converts high fixed-asset investment into variable operating costs, reducing initial financial pressure.

📕 Risk notice

Any interruption in the cold chain (Temperature Excursion) may result in the destruction of an entire batch of high-value medicines, causing substantial financial losses. More seriously, if the issue is not detected promptly and the medicines are sold, patient safety may be threatened, leading to serious legal and reputational risks. There must be no compromise in cold-chain management.

Q285 · 我是否需要为我的药品业务购买商业保险?主要应覆盖哪些方面?独立链接
Yes, purchasing comprehensive commercial insurance for your medicine business is an essential risk-management measure. You should focus on the following types of insurance: 1. “Public Liability Insurance”, which provides cover for compensation claims for third-party personal injury or property damage arising from your business activities (for example, a customer slipping in your shop). 2. “Product Liability Insurance”, which is of central importance and covers compensation claims for injury to users caused by defects in products you sell. 3. “Property All Risks Insurance”, which covers your assets, such as your shop, warehouse, equipment and inventory, against losses caused by events such as fire, theft and flooding. 4. “Employees' Compensation Insurance”, which is compulsory by law and is commonly known as employees' compensation insurance.

📘 Regulatory basis

The Employees' Compensation Ordinance (Cap. 282) requires all employers to take out employees' compensation insurance for their employees. Although other types of insurance are not compulsory, the Department of Health may consider whether a licence holder is “fit and proper” by taking account of the adequacy of its risk management measures. Taking out insurance is an important part of this.

📗 Drew Tang's recommendations

Insurance is fundamentally about transferring risk. We strongly recommend working with a professional insurance broker who can tailor a comprehensive insurance plan to your specific business (wholesale, retail or manufacturing) and product risks (high-risk biological products or low-risk health supplements). Premiums should be regarded as a key investment in business continuity.

📕 Risk notice

Trying to “save” on insurance is an extremely dangerous short-sighted approach. A serious product liability claim could amount to millions or even tens of millions of Hong Kong dollars, enough to bankrupt any uninsured SME instantly. You could lose not only your business, but potentially all your personal assets.

Q303 · 香港的药品优良运销规范(GDP)对仓储设施的温湿度监控有何具体要求?我们应如何达标?独立链接
Good Distribution Practice (GDP) requirements for temperature and humidity control are very strict because improper storage conditions can directly affect the stability and efficacy of medicines. First, medicines must be stored according to the label instructions (such as “Store below 25°C” or “Refrigerate at 2–8°C”). The warehouse must be equipped with a sufficient number of calibrated temperature and humidity monitoring devices to record data continuously. Based on the results of a temperature mapping study, the probes should be strategically positioned at points in the warehouse representative of extreme temperatures (the highest and lowest). Data records should be reviewed regularly (for example, daily). Any deviation from the pre-set range must be documented, and corrective and preventive action (CAPA) taken immediately. Backup power and alarm systems should also be provided to deal with unexpected power outages or equipment failures.

📘 Regulatory basis

The Drug Office, Department of Health’s Good Distribution Practice for Pharmaceutical Products and its technical guidelines set out in detail the requirements for temperature and humidity control, monitoring, recording and calibration in storage areas. These requirements are intended to ensure that medicines remain under the conditions specified on their labels throughout storage.

📗 Drew Tang's recommendations

We strongly recommend that clients invest in an automated electronic temperature and humidity monitoring system that complies with 21 CFR Part 11. Such systems provide real-time data, remote alerts and tamper-proof electronic records, greatly reducing the burden and risks of manual record-keeping. Temperature mapping studies should take into account different scenarios, such as a fully loaded and empty warehouse, and summer and winter conditions, to ensure the study is comprehensive. Calibration services must be performed by an accredited third-party organisation.

📕 Risk notice

Incomplete temperature and humidity records, uncalibrated monitoring equipment, or failure to take any action in response to temperature deviations are serious GDP breaches. If discovered, the regulator may consider the quality of your stock of medicines unreliable, may require you to destroy the affected batches, and may take action against your licence. This is an area that must never be taken lightly.

Q315 · 药品仓库的害虫控制(Pest Control)有哪些具体要求?可以自己处理吗?独立链接
Pests (such as rodents, cockroaches, ants and birds) pose a direct threat to the packaging and quality of medicines. An effective, ongoing pest control programme is therefore a basic GDP requirement for storage facilities. The programme should be based on a risk assessment of the warehouse environment. Specific requirements include: 1. Keep the area around the warehouse clean and remove potential breeding sites; 2. Ensure the warehouse structure is in good condition and seal all possible pest entry points (such as gaps around doors and openings for pipes); 3. Strategically place monitoring and control devices, such as rodent traps and insect glue boards, inside and outside the warehouse, and prepare a placement plan; 4. Inspect these devices regularly and record inspection findings and any pests caught; 5. Manage waste strictly and remove it promptly. As pesticides may themselves contaminate medicines, open toxic baits and spray pesticides should be avoided in medicine storage areas.

📘 Regulatory basis

Chapter 3, “Premises and Equipment”, of the Good Distribution Practice (GDP) for Medicinal Products requires storage areas to be kept clean, with appropriate procedures for cleaning up any spillages, and an effective pest control programme to be implemented. Pest control substances must not themselves pose a contamination risk to medicines.

📗 Drew Tang's recommendations

We strongly recommend outsourcing pest control to a professional and reputable third-party company. Such companies have the expertise, equipment and compliant pesticides to provide systematic services and complete documentation (such as service reports, site plans showing treatment points and pesticide safety data sheets). This is more efficient, safer and easier to demonstrate as compliant during regulatory inspections than handling it yourself. You should sign a contract with the service provider and review its service reports regularly.

📕 Risk notice

Signs of pest activity in a warehouse, such as droppings or gnaw marks, indicate a serious failure to meet hygiene standards. If pests damage the integrity of medicine packaging, the entire batch may be regarded as contaminated and have to be destroyed. Improper use of pesticides by staff can have consequences worse than the pests themselves if the medicines become contaminated.
