Q8 · Category A: Pharmacy licensing system and regulatory foundations (Q1-Q50)
When applying for various pharmaceutical licences in Hong Kong, the regulatory authorities attach great importance to whether the applicant company’s key personnel have appropriate qualifications and experience. The specific requirements vary by licence type. For a Wholesale Dealer Licence, the company must appoint a Responsible Person (RP) who can demonstrate sufficient knowledge and experience to oversee the wholesale business and ensure compliance with Good Distribution Practice (GDP) requirements. A Manufacturer of Pharmaceutical Products licence requires a qualified Authorised Person (AP) and production manager, who must have academic qualifications in pharmacy, chemistry or a related discipline and extensive experience in pharmaceutical manufacturing and quality control. For a Pharmacy / Authorised Seller of Poisons (ASP) licence, the law expressly requires the business to be ‘personally managed and controlled’ by a registered pharmacist. These key personnel are central to ensuring that the licence holder continues to comply with regulations and safeguards medicine quality, so their qualifications and backgrounds are subject to strict scrutiny by the Department of Health.

📘 Regulatory basis

The Pharmacy and Poisons Regulations clearly specify pharmacist requirements for pharmacies. Requirements for key personnel of wholesale dealers and manufacturers are mainly set out in the various Codes of Practice issued by the Department of Health, such as GDP and GMP guidelines.

📕 Risk notice

Submitting information about unsuitable key personnel, or overstating their experience in the application materials, is a common reason for refusal. If a key person leaves, the licence holder must notify the Department of Health immediately and appoint a suitable replacement as soon as possible; otherwise, the licence may be at risk.
