Q101 · Category C: Applicant eligibility and personnel requirements (Q101–Q150)
A company applying for a pharmaceutical product wholesale dealer licence in Hong Kong must be a limited company duly incorporated under Hong Kong's Companies Ordinance (Cap. 622). This is the basic requirement for the applicant entity. In addition, the company must have a fixed, lawful business address in Hong Kong to serve as its registered office and actual place of business. The premises must meet the standards for medicine storage, management and distribution under the Pharmacy and Poisons Ordinance and its subsidiary regulations. Before issuing a licence, inspectors from the Drug Office, Department of Health will conduct an on-site inspection to ensure that the facilities, security system, temperature controls and Quality Management System meet statutory requirements. The company must also demonstrate a sound financial position sufficient to support the normal operation of its licensed pharmaceutical business.

📘 Regulatory basis

Under the Pharmacy and Poisons Ordinance (Cap. 138) and the Code of Practice for Drug Dealers issued by the Drug Office, applicants must be corporate bodies with actual business operations in Hong Kong. Their premises must meet the requirements of Good Distribution Practice (GDP) for medicines.

📗 Drew Tang's recommendations

We recommend that clients complete company registration and rent or purchase suitable business premises before submitting an application. We will help clients review the tenancy agreement to ensure that it meets the Drug Office requirements. Establishing a complete QMS document set in advance is also a key advantage during the on-site inspection.

📕 Risk notice

Do not use a virtual office or company secretary’s address as your business premises for an application; it is almost certain to be rejected. If the premises’ physical facilities (such as air conditioning, refrigerators and security systems) fail to meet the requirements during inspection, the application process may be seriously delayed or you may even need to reapply.
