Under section 38 of the Pharmacy and Poisons Ordinance (Cap. 138), advertisements for medicines must not contain false or misleading content or promote unapproved therapeutic claims. Cross-border e-commerce sellers must ensure that all advertising complies with the requirements of the Hong Kong Drug Office and must not directly or indirectly promote prescription medicines to the public. Rengangyongsheng (Hong Kong) Limited recommends that sellers work with a professional compliance team to review advertising content and ensure that promotional copy meets regulatory requirements, avoiding regulatory penalties for non-compliant advertising.
