Q430 · Category I: Renewals, changes and penalties for non-compliance (Q401-Q450)
The Drug Office, Department of Health and the Chinese Medicine Council of Hong Kong both have channels for handling public complaints and accept anonymous complaints. After receiving a complaint, whether anonymous or identified, the regulatory authority conducts an initial assessment. If the complaint is specific and clear and concerns conduct that may breach relevant legislation or a code of practice, the authority will usually open a case and investigate. The investigation may include unannounced inspections of the licensed premises concerned, examination of relevant records and interviews with relevant personnel. Although anonymous complaints do not allow investigators to obtain further information from the complainant, they are still taken seriously.

📘 Regulatory basis

Handling public complaints is part of a regulatory agency’s duty to protect public health. Risk assessment of all information received is part of its standard procedures.

📗 Drew Tang's recommendations

Do not assume that nobody knows what you are doing. Your employees, customers and even competitors may make a complaint. The only way to respond is to operate compliantly at all times, ensuring that every part of your business can withstand scrutiny.

📕 Risk notice

Anonymous complaints are one important source of information that helps regulators identify possible non-compliance. Do not assume that a breach will go undetected simply because it is concealed. A single unannounced inspection may expose all non-compliant practices.
