The Disciplinary Committee is a statutory body established under the Pharmacy and Poisons Ordinance to hear cases concerning professional misconduct or breaches by licence holders or registered pharmacists. It is not a standing committee; when a case requires an inquiry, the chairperson of the Pharmacy and Poisons Board (PPB) appoints members from among the Board’s members. Under the law, the Disciplinary Committee must comprise at least three members, and its chairperson must be the chairperson of the PPB or another member appointed by the chairperson. Its members usually include pharmacists, doctors and government representatives, helping to ensure that decisions are professional and impartial.

📘 Regulatory basis

Section 9 of the Pharmacy and Poisons Ordinance (Cap. 138) authorises the PPB to establish a disciplinary committee and sets out its composition and powers.

📗 Drew Tang's recommendations

A disciplinary hearing is a very serious quasi-judicial process. If you receive a hearing notice, you must treat it seriously. Understanding the committee’s composition can help you understand its concerns. Your statement and submissions should focus on professional standards, operating procedures and the public interest, rather than solely on commercial considerations.

📕 Risk notice

Do not underestimate the powers of the Disciplinary Committee. It may suspend or permanently revoke your licence or registration. Giving false testimony or misleading the Committee at a hearing is itself serious misconduct that may aggravate the penalty.
