Q241 · 在整个申请过程中,我作为公司董事,扮演什么角色?是否必须亲自参与所有环节?独立链接
As a director of the applicant company, you are ultimately responsible for the entire project and are legally accountable for the success of the application and the company's future compliant operations. Your core role is to make decisions and provide resources. You need to make key decisions, such as approving the budget, selecting the premises and appointing the RP. You must also ensure that sufficient resources are provided to support the establishment of a fully compliant operating system. During the application process, you do not necessarily need to handle every technical detail personally, such as completing forms or drafting SOPs; these tasks may be delegated to professional consultants such as us. However, your involvement is necessary at certain key stages, such as when developing the overall application strategy with us and when reviewing and signing the application documents. In addition, although uncommon, in certain special circumstances the PPB may wish to meet with company directors to understand their commitment to the business and awareness of the importance of compliance.

📘 Regulatory basis

The Companies Ordinance sets out directors’ duties, including the duty to exercise reasonable care, skill and diligence. In the context of medicines regulation, this means directors are responsible for ensuring that the company complies with all relevant laws and regulations, including the Pharmacy and Poisons Ordinance.

📗 Drew Tang's recommendations

We recommend that directors adopt a management approach of “active oversight and professional delegation”. Professional matters should be entrusted to professionals, while a clear reporting mechanism should be established to keep you regularly informed of application progress and any issues encountered. We will provide regular project reports, enabling you to retain full oversight without being burdened by day-to-day details.

📕 Risk notice

The greatest risk is “complete disengagement”. If directors take no interest in the application process and rely entirely on subordinates or consultants, key decisions may be delayed or made incorrectly. More seriously, directors cannot disclaim responsibility by saying they “did not know” if the company commits a serious breach in the course of its operations. The regulator and the courts may hold directors personally liable.

Q242 · 如果在申请期间,我的公司收到了关于某个计划经营产品的投诉,我该如何处理?独立链接

📘 Regulatory basis

The Code of Practice for Wholesale Dealers requires licence holders to have written procedures for handling product complaints. Although you are not yet a licence holder during the application period, establishing this procedure in advance is important evidence that you are capable of becoming a qualified licence holder.

📗 Drew Tang's recommendations

We will draft a world-class complaint-handling SOP for you. If such a situation arises, we will guide you on how to initiate the process, communicate with the supplier and document the entire handling process to create a complete “case file”. This file will be a powerful demonstration of your professionalism when communicating with inspectors.

📕 Risk notice

The risk lies in disregarding potential complaints. If you assume “I have not started operating yet, so it has nothing to do with me” and ignore a complaint, this sends a dangerous signal. If the product later develops a genuine quality issue and the regulator discovers that you had an opportunity to raise the alarm but took no action, your credibility will be seriously damaged.

Q243 · 申请药剂制品制造商(药厂)牌照的审批程序与批发商牌照有何天壤之别?独立链接

📘 Regulatory basis

The GMP guidelines published by the Pharmaceutical Inspection Co-operation Scheme (PIC/S) are globally recognised standards and are a principal basis on which the Hong Kong Department of Health approves pharmaceutical manufacturers. Hong Kong law also requires all medicines sold in Hong Kong to be manufactured by a licensed manufacturer.

📗 Drew Tang's recommendations

Setting up a pharmaceutical manufacturing plant is a major undertaking that requires top-level professional support. Rengangyongsheng (Hong Kong) Limited has a team of experienced GMP experts with backgrounds in international pharmaceutical manufacturing. We can provide end-to-end, turnkey consultancy services, from conceptual plant design, process layout, equipment selection and system establishment to final GMP certification. This decision requires careful planning and substantial investment, so we recommend discussing it with us in depth before getting started.

📕 Risk notice

The greatest risk is underestimating the complexity of GMP and the ongoing investment it requires. GMP certification is not a one-off exercise: you must continue to invest substantial resources in maintaining the GMP system and undergo recertification periodically. Any lapse, such as loss of control over the cleanroom environment or incomplete batch records, may result in suspension of your manufacturing licence and the loss of your entire investment.

Q244 · 我是否可以用一个虚拟办公室(Virtual Office)地址来注册公司和申请药品牌照?独立链接

📘 Regulatory basis

Both the Code of Practice for Wholesale Dealers and the Code of Practice for the Guidance of Pharmacy have extensive provisions on the specific physical requirements for “premises”. A virtual office clearly cannot meet any of them. The licence application form also expressly requires a physical business address.

📗 Drew Tang's recommendations

We recommend that clients clearly distinguish between the two concepts: the company’s registered address may be a company secretarial firm’s address or a virtual office selected for convenience; however, the licensed address for the medicines licence must be a fully compliant physical warehouse or shop into which you have invested heavily and made careful preparations. Ensure that these two addresses are not confused on any form.

📕 Risk notice

The risk lies in confusion about the meaning of “address”. Incorrectly declaring a virtual office address in a licence application could not only result in rejection, but also cause the regulator to question your professionalism and seriousness. This may have an unnecessary negative impact if you later reapply using a genuine address. This elementary mistake should be avoided altogether.

Q245 · 在现场视察时,除了负责人(RP),其他员工是否也可能被督察提问?独立链接

📘 Regulatory basis

The Code of Practice for Wholesale Dealers stresses the importance of ongoing training for all staff engaged in wholesale activities. Spot questions are a direct way to assess the effectiveness of training and an effective means of checking whether SOPs are “embedded in staff practice”.

📗 Drew Tang's recommendations

“Everyone is ready for action” is our training philosophy. Before an inspection, we not only provide focused guidance to your RP but also offer tailored question-and-answer training and practice sessions for all your key staff, such as warehouse supervisors and quality assistants. We ensure that when inspectors ask questions, every team member can give confident, accurate answers that fully accord with your SOPs.

📕 Risk notice

The risk is that “only the RP understands it”. If inspectors find that staff other than the RP know nothing about the SOPs, or that actual practices differ significantly from the SOPs, they may reach a very negative conclusion: that your quality system is merely a “paper exercise” created to get through inspections. This would be a major deficiency and could well result in a failed inspection.

Q246 · 如果我的负责人(RP)在申请过程中突然离职,我该怎么办?独立链接

📘 Regulatory basis

The person responsible is one of the core elements of a pharmaceutical licence application. Without a qualified person responsible, the applicant entity is no longer complete and the application process must be suspended. This reflects the regulator’s recognition of the critical role of people in a quality system.

📗 Drew Tang's recommendations

To deal with this unexpected situation, we recommend appointing and training one or two deputy RPs at the start of the project. If the RP leaves, you can immediately apply to the Department of Health to appoint the most experienced deputy RP as the formal RP. As this deputy RP’s details will already have been submitted with the application and they will already have received training, the Department of Health’s review is likely to be much faster, minimising delays caused by personnel changes.

📕 Risk notice

The greatest risk is “delay” and “concealment”. If you try to conceal the fact that the RP has left, or delay appointing a new RP, your application may ultimately be refused on the grounds that you “cannot meet the basic requirements”. This not only wastes all the time and resources invested so far, but also seriously damages your credibility with the regulator.

Q247 · 我的业务包含对药品进行二次包装(Secondary Packaging),这在审批上有什么额外要求?独立链接

📘 Regulatory basis

Under PIC/S GMP guidelines, secondary packaging is considered part of manufacturing. Accordingly, such activities require explicit authorisation from the Department of Health and must comply with simplified GMP requirements, also known as “GMP-light”.

📗 Drew Tang's recommendations

If you need to carry out secondary packaging, we will plan for this specifically from the start of the project. We will design a compliant packaging room, draft a complete set of packaging SOPs and guide you on preparing batch packaging records correctly. We will ensure that, when you apply, you can clearly demonstrate to the Department of Health that you are capable of carrying out safe, compliant secondary packaging.

📕 Risk notice

The risk lies in repackaging without authorisation. If you hold only an ordinary Wholesale Dealer Licence but secretly split packs or relabel products in your warehouse, this amounts to serious unlicensed manufacturing. If discovered, the consequences will be severe: your Wholesale Dealer Licence may be revoked, and the company and persons responsible may also face criminal prosecution.

Q248 · 在正式递交全套申请文件之前,我应该做哪些最终的检查?独立链接

📘 Regulatory basis

The Department of Health’s application guide clearly lists the documents that must be submitted. Any missing or incorrect document may be sufficient reason for an reviewing officer to request further information, triggering the first stage of a delay.

📗 Drew Tang's recommendations

As your consultant, we will carry out this final quality-control step for you. After you have signed all the documents, we will conduct an independent final review, cross-checking everything. We will put ourselves in the position of the most meticulous reviewing officer and try to identify potential issues in every detail. The application will not be submitted until it has passed our internal approval. This is the final safeguard underpinning our commitment to a “zero-defect application”.

📕 Risk notice

The risk is that “everything falls at the final hurdle”. You may spend months carefully preparing the premises and SOPs, only for your application to be returned because of a simple clerical error, such as an incorrectly named payee on a cheque or a missing signature on a document. This is not only frustrating but also wastes valuable time. A thorough final check is key to avoiding such elementary mistakes.

Q249 · 我的申请获批后,牌照的有效期是多久?我需要提前多久准备续期?独立链接

📘 Regulatory basis

The Pharmacy and Poisons Regulations set out the validity period and renewal requirements for licences. Licence holders are responsible for proactively and promptly renewing their licences to maintain their lawful operating status.

📗 Drew Tang's recommendations

For our annual service clients, licence renewal is a basic part of our service. We will maintain a renewal calendar and remind you automatically at the right time, as well as prepare all renewal documents for you to sign. We will handle all submissions and follow-up work to ensure continuity of your licence, so you do not need to worry about it.

📕 Risk notice

The greatest risk is “forgetting to renew”. This may sound unbelievable, but it can happen amid busy business operations. Once your licence expires without renewal, you must immediately cease all licensed activities. Reactivating the licence may require a process more complicated than a normal renewal and may even require a new on-site inspection. This can seriously disrupt and damage your business.
