The official requirements for a pharmaceutical licence application in Hong Kong do not make it mandatory for applicants to submit a detailed business plan. The regulatory authorities’ main concern is whether you meet the statutory compliance requirements for premises, personnel and the QMS. They are more concerned with “how you will operate compliantly” than with “how you will make a profit”. This does not mean, however, that a business plan is of no use. Although it is not required, a professional and rigorous business plan can be a very persuasive supporting document. It can help reviewing officers better understand your business model, company background, management team’s expertise and commitment to long-term compliant operations. In some borderline cases—for example, where the Responsible Person (RP) has an unconventional background—a business plan setting out a clear development roadmap and sound financial projections may provide useful support.

📘 Regulatory basis

The legal basis for approval is the Pharmacy and Poisons Ordinance and its subsidiary legislation. These laws focus primarily on public health and pharmaceutical safety, not commercial viability. A business plan is therefore not a statutory submission document.

📗 Drew Tang's recommendations

We recommend that clients prepare a concise yet professional business plan summary as an attachment to the application. We will help you highlight compliance-related matters in the summary, such as the company’s commitment to quality management, staff training plans and strategic reasons for choosing Hong Kong as a business base. This presents your capability and commitment to regulators in a highly professional manner and helps create a positive impression.

📕 Risk notice

The risk lies in submitting a business plan that is exaggerated, unrealistic or riddled with compliance gaps. For example, the proposed business scope may far exceed what your current facilities and personnel can support, or the marketing section may make prohibited medical claims. A document intended to be “clever” may instead raise the regulator’s concerns and lead to closer scrutiny of your application.
