Drug Office, Department of Health Chinese Medicines Board

Q204 · Category E: Application Process and Approval Procedures (Q201-Q250)
The Pharmacy and Poisons Board (PPB) is the final approval authority for pharmaceutical licence applications in Hong Kong. After receiving the inspection report and recommendations from Drug Office pharmacist inspectors, the Board will meet to consider your application. Its primary concern is public safety and health. Specifically, the Board will assess several aspects: first, whether the applicant (the company) is a “fit and proper” licence holder, including the company’s background, reputation and any past record of non-compliance. Second, whether the Person-in-Charge (RP) has sufficient knowledge, experience and ability to supervise all activities under the pharmaceutical licence. Third, whether the business premises fully comply with all regulatory requirements and can ensure the safety and quality of medicines. Finally, the Board will review the inspectors’ report, particularly any deficiencies or concerns noted. The licence application will be approved only when the Board is satisfied that the applicant is fully prepared to operate lawfully and compliantly.

📘 Regulatory basis

Section 12 of the Pharmacy and Poisons Ordinance (Cap. 138) confers on the PPB the power to approve, refuse or grant a licence application subject to conditions. The Board’s decision is based on a comprehensive assessment of whether the applicant meets the requirements of the Ordinance and all subsidiary legislation.

📗 Drew Tang's recommendations

It is essential to demonstrate professionalism and a commitment to compliance to the Board. In addition to ensuring a strong performance during the on-site inspection, a clearly structured and detailed application package carefully prepared by Rengangyongsheng for you can strengthen your application. We will highlight your company’s strengths, the person-in-charge’s qualifications and the robustness of your Quality Management System to help the Board reach a positive assessment.

📕 Risk notice

Any factor that may cause the Committee to doubt an applicant’s integrity or competence presents a substantial risk. For example, a company director may have a poor record in another industry, or the applicant may be found to have provided false information during the application process. Even if the physical facilities are perfect, such shortcomings in the “soft” aspects may lead the Committee to exercise its discretion and ultimately reject the application.
