Drug Office, Department of Health Chinese Medicines Board

Q214 · Category E: Application Process and Approval Procedures (Q201-Q250)
Receiving “Conditional Approval” is a relatively positive sign. It means that the PPB has agreed in principle to your application, but requires you to complete specific corrective actions or meet additional conditions before the licence is formally issued. These conditions are usually based on minor deficiencies identified during an on-site inspection, or on an area that the Board considers needs to be strengthened. For example, the Board may require you to “submit detailed staff training records within three months of the licence being issued” or “install a higher-grade security system before formally commencing operations”. You should first carefully review all the conditions listed in the approval letter; then draw up a clear plan to meet each one; and finally, once all conditions have been met, notify the Department of Health in writing and provide supporting documents (such as photographs, receipts and records). The Department of Health will formally issue the licence only after verifying that all conditions have been met.

📘 Regulatory basis

Section 12 of the Pharmacy and Poisons Ordinance expressly authorises the PPB, where it considers appropriate, to attach such conditions to the grant of a licence as it considers appropriate. This is a common tool used by the regulator to manage risks and ensure licence holders’ ongoing compliance.

📗 Drew Tang's recommendations

We will help you interpret the regulatory intent behind each “condition” precisely and provide the most cost-effective and efficient solution. For example, if a condition concerns an SOP revision, we will draft a compliant version for you. We will manage the entire “condition fulfilment” project to ensure that you complete all requirements as quickly as possible and submit a comprehensive response to the Department of Health, so that you can obtain the formal licence as soon as possible.

📕 Risk notice

Taking additional conditions lightly or delaying compliance is a major risk. If you fail to meet all the conditions within the specified period, or the measures you take do not satisfy the Department of Health, the “conditional approval” may be revoked and your application may revert to rejected status. This would mean failing at the final hurdle.
